Official Rules

1. Eligibility:

   Sweepstakes is open to legal residents of the United States, the District of Columbia and Canada aged 18 years of age or older as of date of entry. Employees, officers and directors of the Sponsor, its parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, and their immediate families (or members of the same household, whether related or not) are not eligible to enter. Void outside of the US and Canada, void in the Province of Quebec, Canada, and void where ever else prohibited or restricted by law. All federal, state and local laws and regulations apply.

2. Start/End Dates:

   Sweepstakes entry period begins at 8:00:01 a.m. PST, June 14, 2023, and ends at 5:59:59 p.m. PST on July 31, 2023 (“Entry Period”).

3. How to Enter:

   To be eligible for the Sweepstakes drawing, you must submit as directed during the applicable calendar month during the Entry Period a review (“Review”) of a tCheck device on www.tcheck.me or https://www.amazon.com/tCheck-Controlled-Potency-Infusions-Green/dp/B09KDX43XV and complete the requested information that together with your Review will constitute your Official Entry into the Sweepstakes. The Review must be at least 50 characters long, and can include attached video content. One entry per person per tCheck device during the Entry Period.

   All entry information, including the Review, shall be collectively referred to herein as the “Submissions” or each as a “Submission.”

   By entering, each entrant warrants and represents the following with respect to entrant’s Submission: (a) entrant is the sole and exclusive owner of the Submission; and (b) the Submission will not infringe on any rights of any third parties. A Submission may not contain any content as determined by Sponsor in its sole discretion that is sexually explicit, suggestive, profane, pornographic, violent or derogatory of any ethnic, racial, gender, religious, professional or age group; promotes (or the use thereof) alcohol, illegal drugs, tobacco, firearms/weapons; promotes any activity that appears unsafe or dangerous; promotes any particular political agenda or message; is obscene, offensive, or endorses any form of hate or hate group; defames, misrepresents or contains disparaging remarks; contains trademarks, logos, copyrights, trade dress or other property owned by others, without proper permission; or contains any personal information – such as addresses, telephone numbers, personal names or email addresses.

   Providing a Submission constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submissions in whole or in part, on a worldwide basis, in perpetuity, and to incorporate it into other works, in any form, media or technology now known or later developed, for any purpose whatsoever, including for promotional or marketing purposes.

   Multiple entrants are not permitted to share the same email account. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any email account, the authorized account holder of the email address used to register for the account will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.

   All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Sweepstakes.

4. Random Drawing/Odds:

   At the end of the Entry Period, there will be three winners randomly selected within five (5) business days following the end of each month during the Entry Period from all eligible entries received prior to the end of that month. Odds of winning depend on the number of eligible entries received for the drawing. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Sweepstakes.

5. Prizes:

   Each randomly selected winner will be awarded a prize of $50 Amazon gift card, redeemable at Amazon. Dollar value of prize will either be in US or Canadian currency based on the winner’s country of residence. Nonwinning entries will be carried over to any subsequent monthly drawings during the Entry Period. Odds of winning depend on the number of eligible entries received.

   No substitutions. In the case of unavailability of a prize, Sponsor reserves the right to substitute a prize of equal or greater value. 

6. Notification:

   The potential winner will be selected and notified by email. If any potential winner cannot be contacted within five (5) days of first notification attempt, if any potential winner rejects his/her prize, or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner may be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. Limit one prize per person or household. Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes at any time in its sole discretion.

7. Conditions:

   Participation in Sweepstakes and acceptance of prize constitutes each winner’s permission for Sponsor to use his/her name, likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by each winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By entering the Sweepstakes, entrants agree to be bound by these Sweepstakes rules and by the decisions of the Sponsor, which are final as to all Sweepstakes related matters. In addition, by participating in this Sweepstakes and accepting any prize that may be won, entrants agree to release and hold harmless the Sponsor, its respective parents, subsidiaries, affiliated and successor companies, partners, representatives, assigns, advertising and promotion agencies and prize suppliers, and the officers, directors, agents, representatives and employees of each (collectively, the "Released Parties") from any and all actions, claims, liability, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize, including without limitation claims for property damage, personal injury and/or death, and for any claims based on publicity rights, trademark infringement or any other intellectual property related cause of action. Entrants also authorize the Released Parties to use their name, voice, likeness, image, biographical data, any statements made by entrant regarding the Sweepstakes and city and state of residence in programming or promotional material or on a winners list (if applicable) without further notice or compensation unless prohibited by law. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified. There is no purchase or sales presentation required to participate. A purchase does not increase odds of winning.

8. Limitation of Liability; Disclaimer of Warranties:

   TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THIS SWEEPSTAKES, OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

9. Use of Data:

   Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
